§ 28-2. Burn permits.

  • It shall be unlawful to burn limbs, branches, and leaves unless burned in an incinerator, barrel or similar container and upon obtaining a burn permit from the city fire department. Each person who shall obtain a permit shall sign documentation indemnifying and holding harmless the city and the city fire department for any damages that may result from the burning of limbs, branches and leaves, including, but not limited to, an event in which the fire becomes uncontrollable.

    It shall be unlawful to burn trash or any other debris of any kind, regardless of whether it is in an incinerator, barrel, or similar container.

    In the event the burning of limbs, branches and leaves causes excessive smoke or other conditions in a manner that impacts the neighbors, the city reserves the right to instruct the party to put out the fire. Failure to do so may result in a fine.

    Whoever violates the provisions of this section shall be penalized as provided in section 1-8.
